Please be advised that the Federal Register has now been amended to reflect the current Administration’s decision to increase Section 301 tariff rates on “List 3” Chinese goods from 10% to 25% effective May 10, 2019.
U.S. Customs has issued the following guidance regarding the effective time of entry as it relates to the increased duties:
- “The increase in additional import duties for Chinese goods covered by the September 21, 2018 Federal Register notice, as amended, is now effective on May 10, 2019. Effective with respect to goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern standard time on May 10, 2019, and exported to the United States on or after May 10, 2019, the rate of additional duties on imported articles classified in a subheading covered by the September 21, 2018 Federal Register notice, as amended, will be 25 percent ad valorem.”
It is important to note that goods now in transit that were exported to the U.S. before May 10 will still be eligible for the lower 10% rate, if entry is made before June 1, 2019. After June 1, all List 3 goods will be subject to the 25% tariff.
Last week the U.S. Trade Representative (“USTR”) indicated that the exclusion process for List 3 goods would be published by the end of May. Congress has previously directed the USTR to publish this process no later than March 17.
